BF3 Metro - Is the player in these videos doing something illegal and violated server rules?

This is the video from a second player view (some players describe it as wall glitch, bipod glitch, head glitch, texture glitch, etc. - the interpretation is very subjective):

This is the video from a first person shooter at the same position and there's a difference between what first person shooter see from a second player view. The first person can not shoot thru the wall @ 0:15 as opposed to what the second person player sees in the above video:

I think the only way to tell is someone shooting like that in the first video and a second player checks to see how it looks like from another player's perspective.

That could be a viewable bug if that makes sense.
